Released on September 24, 2002 The Instigator is categorized as an alt-country with well-written songs and a brightly produced album which was almost exactly what the Old 97's fans are expected from him as a solo artist. Songs from this album was featured in a Joan of Arcadia episodes (CBS) and as a soundtrack for the American comedy series Scrubs.

The Instigator is an expression of Rhett Miller's pop side since he has done alt-country, rock songs from Old 97's. Maybe this album was made to separate him from the image he has in his band and be a successful solo artist in his own genre.
